Agreement to Terms

By downloading, installing, or using the PB Match mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

Description of Service

PB Match is a mobile application that helps pickleball players coordinate pickup games. The App allows users to:

  • Create and manage player connections
  • Organize and invite players to matches
  • Manage waitlists for matches
  • Receive notifications about match invitations and updates

Account Registration

To use the App, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

You must be at least 13 years old to create an account.

User Conduct

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the App in any way that violates applicable laws or regulations
  • Impersonate any person or entity
  • Harass, abuse, or harm other users
  • Send spam or unsolicited communications
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App or servers
  • Use automated means to access the App without permission
  • Upload malicious code or content

Match Coordination

The App facilitates coordination between players but does not guarantee:

  • Availability of other players
  • Quality or safety of any match or location
  • Attendance of invited players

You are responsible for:

  • Choosing safe and appropriate match locations
  • Communicating clearly with other participants
  • Your own safety during matches
  • Any equipment or court fees

User Content

You retain ownership of content you submit through the App (such as profile photos and match notes). By submitting content, you grant us a non-exclusive, royalty-free license to use, display, and distribute that content in connection with operating the App.

You are responsible for ensuring your content does not violate any third-party rights or applicable laws.

Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to our collection and use of information as described in the Privacy Policy.

Intellectual Property

The App and its original content, features, and functionality are owned by PB Match and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App without our express permission.

Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

WE MAKE NO WARRANTIES REGARDING:

  • THE ACCURACY OR COMPLETENESS OF APP CONTENT
  • THE RESULTS OF USING THE APP
  • THE CONDUCT OF OTHER USERS
  • THE SAFETY OF ANY MATCH OR LOCATION

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PB MATCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • LOSS OF PROFITS OR DATA
  • PERSONAL INJURY OR PROPERTY DAMAGE
  • ANY DAMAGES ARISING FROM YOUR USE OF THE APP
  • ANY CONDUCT OR CONTENT OF THIRD PARTIES

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO USE THE APP (IF ANY) IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold harmless PB Match, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your content submitted through the App

Account Termination

We may suspend or terminate your account at any time for any reason, including violation of these Terms. You may also delete your account at any time through the App or by contacting us.

Upon termination:

  • Your right to use the App will cease immediately
  • We may delete your account data
  • Provisions that by their nature should survive termination will remain in effect

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App. Your continued use of the App after changes constitutes acceptance of the modified Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in class action lawsuits.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and PB Match regarding the App and supersede any prior agreements.
